Terms of Service | ILX Connection

These Terms of Service ("Terms") govern your use of ILX Connection, the online steel connection design service at ilxconnection.com (the "Service"), provided by ILX Studio, LLC ("ILX Studio", "we", "us"). By creating an account or using the Service you agree to these Terms. If you use the Service for a firm, you confirm that you may accept these Terms on its behalf.

1. The Service #

ILX Connection is a design aid for structural engineers. It performs strength and detailing checks of steel connections based on AISC 360-22 and related references, and produces drawings and calculation reports. It is the online version of the upcoming ILX Connection desktop application.

2. Professional responsibility #

The Service does not replace professional engineering judgment. You, or the engineer of record you work for, are solely responsible for the input, for checking the results, and for every design, drawing and report you issue. Read the Disclaimer, which is part of these Terms.

3. Accounts #

You must give accurate account information and keep your password confidential.
You are responsible for activity under your account. Tell us promptly at support@ilxstudio.com if you suspect unauthorized use.
One account is for one person. Accounts may not be shared.

4. Beta, subscriptions and payment #

New accounts receive a free beta period of 90 days. Features may change during the beta.
After the beta, continued use requires a paid subscription: currently $20 per month or $100 per year, in US dollars, plus any applicable taxes.
Purchases are processed by Stripe, which sells the subscription to you as merchant of record and reseller (your receipt shows "Sold through Link"). Stripe handles checkout, sales tax or VAT, receipts and payment support. Your card details go to Stripe and never reach ILX Studio.
Subscriptions renew automatically until cancelled. You may cancel at any time; the subscription then ends at the close of the paid period.
We may change prices for future periods with at least 30 days' notice.

5. Your content #

Your projects, inputs, drawings and reports ("Your Content") remain yours. You give us permission to store, process and back up Your Content only to provide the Service to you. We do not sell Your Content or use it to market to others.

6. Acceptable use #

You agree not to: attempt to access other users' data; interfere with or overload the Service; reverse engineer the Service except where the law allows; resell or provide the Service to third parties; or use the Service for any unlawful purpose.

7. Availability and changes #

We work to keep the Service available and accurate, but it is provided without a guarantee of uninterrupted operation. We may update, add or remove features. We will give reasonable notice of changes that materially reduce the Service.

8. Intellectual property #

The Service, its software, design and documentation belong to ILX Studio, LLC and its licensors. AISC, the AISC Specification and the Steel Construction Manual are the property of the American Institute of Steel Construction. ILX Studio, LLC is not affiliated with or endorsed by AISC.

9. Warranty disclaimer #

To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement.

10. Limitation of liability #

To the extent permitted by law, ILX Studio, LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or business, arising from the use of the Service. Our total liability for any claim is limited to the amount you paid for the Service in the 12 months before the claim.

11. Termination #

You may close your account at any time. We may suspend or close accounts that breach these Terms. On closing, you may request an export of Your Content within 30 days, after which it may be deleted.

12. Governing law #

These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law rules.
